font-family: Gotham, serif; font-weight: normal;\">\u201d<\/span><\/strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">., inscrita no CNPJ\/MF sob o n\u00ba <\/span><b><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">37.743.906\/0001-06<\/span><\/b><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">, com sede na <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">AE AREA ESPECIAL 4 LOTE I\/J TORRE 03<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">Ao aceitar eletronicamente este Termo, com a marca\u00e7\u00e3o da caixa de di\u00e1logo \u201cLi e concordo com os Termos e Condi\u00e7\u00f5es de Uso\u201d, o USU\u00c1RIO estar\u00e1 automaticamente aderindo e concordando com os termos e condi\u00e7\u00f5es deste Termo e da Pol\u00edtica de Privacidade.<\/span><\/strong><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; margin-bottom: 1rem;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">A utiliza\u00e7\u00e3o do Sistema ou de qualquer Ferramenta ser\u00e1 interpretada com o aceite pleno a este Termo.<\/span><\/strong><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; margin-bottom: 1rem;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">A EZZEPAY poder\u00e1 periodicamente alterar as condi\u00e7\u00f5es deste Termo, ao seu exclusivo crit\u00e9rio; podendo o USU\u00c1RIO, caso n\u00e3o concorde com a modifica\u00e7\u00e3o, denunci\u00e1-lo sem quaisquer \u00f4nus ou penalidades.<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify; background-image: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cAutoriza\u00e7\u00e3o de Pagamento\u201d<\/ins>: opera\u00e7\u00e3o dispon\u00edvel na Plataforma, pela qual o USU\u00c1RIO autoriza a EZZEPAY a utilizar o valor mantido em sua Conta de Pagamento para o pagamento de produtos ou servi\u00e7os fornecidos por outros USU\u00c1RIOS credenciados no Sistema.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cBacen\u201d<\/ins>: Banco Central do Brasil.<\/span><\/li>\n<li style=\"color: #373643; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cCadastro\u201d<\/ins>: formul\u00e1rio preenchido pelo USU\u00c1RIO na Plataforma, contendo seus dados pessoais e demais informa\u00e7\u00f5es necess\u00e1rias para credenciamento ao Sistema e cria\u00e7\u00e3o da Conta de Pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cCart\u00e3o Pr\u00e9-Pago\u201d<\/ins>: cart\u00e3o pl\u00e1stico emitido pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ou por terceiros indicados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, que, caso dispon\u00edvel, poder\u00e1 ser utilizado mediante recursos previamente aportados na Conta de Pagamento do USU\u00c1RIO, para a aquisi\u00e7\u00e3o de bens, servi\u00e7os e\/ou saques, no territ\u00f3rio nacional, perante os estabelecimentos filiados \u00e0 bandeira indicada no respectivo Cart\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cConta de Pagamento\u201d<\/ins>: conta de titularidade do USU\u00c1RIO, destinada ao carregamento, transfer\u00eancia e resgate de recursos, cujos valores, convertidos em moeda eletr\u00f4nica, ser\u00e3o geridos e custodiados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cDisputa\u201d<\/ins>: procedimento de an\u00e1lise do pedido de cancelamento ou estorno da Transa\u00e7\u00e3o feito pelo USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cFerramentas\u201d<\/ins>: tecnologias disponibilizadas pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">na Plataforma, para a realiza\u00e7\u00e3o de Transa\u00e7\u00f5es pelo USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>Pix<\/ins>: arranjo de pagamentos institu\u00eddo pelo Bacen que disciplina a presta\u00e7\u00e3o de servi\u00e7os de pagamento relacionados com as Transa\u00e7\u00f5es de pagamentos instant\u00e2neos no \u00e2mbito do arranjo.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cPlataforma\u201d<\/ins>: site na internet dispon\u00edvel em&nbsp;<a style=\"color: #5e239d;\" href=\"https:\/\/www.uzzipay.com\/\">https:\/\/www.EZZEPAY.com<\/a>&nbsp;e aplicativo para dispositivos m\u00f3veis, de propriedade da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, disponibilizado ao USU\u00c1RIO para a utiliza\u00e7\u00e3o das Ferramentas e realiza\u00e7\u00e3o de Transa\u00e7\u00f5es.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cPol\u00edtica de Privacidade\u201d<\/ins>: pol\u00edtica dispon\u00edvel na Plataforma, que \u00e9 integrante deste Termo, a qual disp\u00f5e sobre a coleta, utiliza\u00e7\u00e3o, armazenamento, tratamento, compartilhamento, prote\u00e7\u00e3o e elimina\u00e7\u00e3o das informa\u00e7\u00f5es do USU\u00c1RIO, em decorr\u00eancia da utiliza\u00e7\u00e3o do Sistema.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cSistema\u201d<\/ins>: servi\u00e7os relacionados \u00e0 abertura de Conta de Pagamento e realiza\u00e7\u00e3o de Transa\u00e7\u00f5es pelo USU\u00c1RIO, incluindo a disponibiliza\u00e7\u00e3o de informa\u00e7\u00f5es e fornecimento de extratos por meio da Plataforma.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cTermo\u201d<\/ins>: este Termo de Ades\u00e3o para Abertura de Conta de Pagamento, que \u00e9 um contrato eletr\u00f4nico dispon\u00edvel na Plataforma.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cTransa\u00e7\u00e3o\u201d<\/ins>: opera\u00e7\u00e3o em que o USU\u00c1RIO realiza a movimenta\u00e7\u00e3o de sua Conta de Pagamento, realizando o carregamento de recursos em sua Conta de Pagamento; a transfer\u00eancia de recursos para a Conta de Pagamento de outros USU\u00c1RIOS credenciados no Sistema; ou o resgate de recursos do USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<ins>\u201cUSU\u00c1RIO\u201d<\/ins>: pessoa jur\u00eddica ou pessoa f\u00edsica que, ao aderir ao presente Termo, est\u00e1 habilitada a realizar Transa\u00e7\u00f5es por meio do Sistema.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; Este Termo regula a presta\u00e7\u00e3o de servi\u00e7os de tecnologia, pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, para: (i) cadastro e credenciamento do USU\u00c1RIO ao Sistema; (ii) cria\u00e7\u00e3o de Conta de Pagamento, habilitando o USU\u00c1RIO a realizar Transa\u00e7\u00f5es para carregamento, transfer\u00eancia e resgate de recursos; e (iii) gest\u00e3o e cust\u00f3dia dos recursos mantidos na Conta de Pagamento de titularidade do USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;2.2. Os servi\u00e7os ser\u00e3o prestados de forma remota, mediante a licen\u00e7a de uso das Ferramentas disponibilizadas ao USU\u00c1RIO na Plataforma.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;2.3. Em contrapresta\u00e7\u00e3o \u00e0 utiliza\u00e7\u00e3o do Sistema, realiza\u00e7\u00e3o das Transa\u00e7\u00f5es e demais servi\u00e7os prestados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, o USU\u00c1RIO pagar\u00e1 as tarifas estabelecidas neste Termo, de acordo com os valores informados no momento do Cadastro e\/ou para consulta na Plataforma.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;2.3.1. A contrata\u00e7\u00e3o de servi\u00e7os espec\u00edficos prestados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ou seus parceiros (conforme dispon\u00edveis na Plataforma) ser\u00e1 estabelecida em instrumentos contratuais pr\u00f3prios.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;2.4. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, sob sua \u00fanica e exclusiva responsabilidade, poder\u00e1 subcontratar terceiros ou realizar parcerias para a presta\u00e7\u00e3o de parte dos servi\u00e7os que integram o Sistema, respondendo integralmente por tal ato.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;<strong>2.5. O USU\u00c1RIO declara-se ciente de que a EZZEPAY n\u00e3o poder\u00e1 ser responsabilizada ou assumir\u00e1 qualquer responsabilidade por falhas, erros, interrup\u00e7\u00f5es, mau funcionamento, atrasos ou outras imperfei\u00e7\u00f5es que possam surgir nos servi\u00e7os prestados no \u00e2mbito deste Termo, ainda que de responsabilidade da EZZEPAY ou de seus parceiros, n\u00e3o garantindo a manuten\u00e7\u00e3o do Sistema de forma ininterrupta, sem momentos de indisponibilidade ou lentid\u00e3o e de forma isenta de erros.<\/strong><\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">3. Credenciamento ao Sistema<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.1. O credenciamento ao Sistema ser\u00e1 realizado pela ades\u00e3o do USU\u00c1RIO a este Termo, que se efetivar\u00e1 pelo: (i) preenchimento do Cadastro; e (ii) pelo aceite eletr\u00f4nico expressamente manifestado na Plataforma.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.2. Para utiliza\u00e7\u00e3o do Sistema, o USU\u00c1RIO dever\u00e1 obrigatoriamente preencher o Cadastro, fornecendo seus dados pessoais e informa\u00e7\u00f5es que venham a ser solicitados na Plataforma, sendo:<br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) Para pessoa f\u00edsica, cujo saldo seja limitado a R$5.000,00 (cinco mil reais) e na qual o somat\u00f3rio dos aportes efetuados em cada m\u00eas seja limitado a este mesmo valor, dever\u00e3o ser fornecidos: nome completo e n\u00famero de inscri\u00e7\u00e3o no CPF\/MF v\u00e1lido e ativo;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(b) Para pessoa f\u00edsica, cujo saldo seja limitado a R$5.000,00 (cinco mil reais) e na qual o somat\u00f3rio dos aportes efetuados em cada m\u00eas seja superior a este valor, dever\u00e3o ser fornecidos: nome completo, n\u00famero de inscri\u00e7\u00e3o no CPF\/MF v\u00e1lido e ativo, data de nascimento, endere\u00e7o de resid\u00eancia, n\u00famero do telefone com DDD e o nome completo da m\u00e3e; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(c) Para pessoa jur\u00eddica, dever\u00e3o ser fornecidos: raz\u00e3o social ou denomina\u00e7\u00e3o, n\u00famero de inscri\u00e7\u00e3o no CNPJ\/MF v\u00e1lido e ativo, atividade principal, forma e data de constitui\u00e7\u00e3o, n\u00famero de inscri\u00e7\u00e3o no CPF e nome completo dos representantes, mandat\u00e1rios, ou prepostos autorizados a executar instru\u00e7\u00f5es de pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.2.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 limitar a utiliza\u00e7\u00e3o do Sistema, de acordo com o valor e quantidade de Transa\u00e7\u00f5es.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.2.2. Sempre que necess\u00e1rio, inclusive para possibilitar a utiliza\u00e7\u00e3o do Sistema para realiza\u00e7\u00e3o de Transa\u00e7\u00f5es em valor e quantidade aos limites estabelecidos, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 solicitar, mediante comunica\u00e7\u00e3o na Plataforma, que o USU\u00c1RIO forne\u00e7a informa\u00e7\u00f5es complementares \u00e0quelas indicadas no Cadastro, bem como poder\u00e1, a qualquer momento, e ao seu exclusivo crit\u00e9rio, solicitar c\u00f3pias de documentos para averiguar a veracidade das informa\u00e7\u00f5es prestadas pelo USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.2.3. Na hip\u00f3tese de a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">verificar dados incorretos ou inver\u00eddicos fornecidos pelo USU\u00c1RIO ou, ainda, caso o USU\u00c1RIO se recuse ou se omita a enviar as informa\u00e7\u00f5es e documentos solicitados, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 suspender temporariamente o acesso ao Sistema e impedir a utiliza\u00e7\u00e3o das Ferramentas at\u00e9 que haja a regulariza\u00e7\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.2.4. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1, a seu exclusivo crit\u00e9rio, realizar pesquisas, em base de dados p\u00fablicas ou privadas, com a finalidade de verificar a veracidade dos dados e informa\u00e7\u00f5es indicadas pelo USU\u00c1RIO no Cadastro.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.3. O USU\u00c1RIO se responsabiliza civil e criminalmente pela veracidade das informa\u00e7\u00f5es prestadas, inclusive perante terceiros, obrigando-se a manter seus dados atualizados perante a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.3.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">n\u00e3o ser\u00e1 respons\u00e1vel por erros ou pela inexecu\u00e7\u00e3o dos servi\u00e7os que integram o Sistema caso o USU\u00c1RIO preste informa\u00e7\u00f5es inexatas, inver\u00eddicas ou desatualizadas.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.4. O USU\u00c1RIO, quando do preenchimento do Cadastro ou primeiro acesso ao Sistema, dever\u00e1 cadastrar login e uma senha para acesso ao APP e cadastrar o c\u00f3digo de seguran\u00e7a (\u201cPIN\u201d) para utiliza\u00e7\u00e3o das Ferramentas e realiza\u00e7\u00e3o das Transa\u00e7\u00f5es.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.4.1. O uso do login, senha e PIN s\u00e3o de uso pessoal, exclusivo e intransfer\u00edvel pelo USU\u00c1RIO, que dever\u00e1 mant\u00ea-los confidenciais e n\u00e3o permitir seu acesso por terceiros.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.4.2. O USU\u00c1RIO, na qualidade de pessoa jur\u00eddica, se compromete a somente dar acesso ao login, senha e PIN para seus representantes legais, s\u00f3cios, administradores e\/ou prepostos com poderes para celebrar neg\u00f3cios jur\u00eddicos em seu nome; sendo respons\u00e1vel, perante \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, outros USU\u00c1RIOS e terceiros, por todos os atos e neg\u00f3cios realizados por meio da utiliza\u00e7\u00e3o do Sistema.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.4.3. O USU\u00c1RIO dever\u00e1 imediatamente comunicar a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">sobre a perda, extravio ou acesso indevido ao seu login, senha e PIN, para que possam ser adotadas as medidas necess\u00e1rias para bloqueio do acesso ao Sistema. Ser\u00e3o consideradas de responsabilidade do USU\u00c1RIO todos os atos e neg\u00f3cios realizados at\u00e9 a data da comunica\u00e7\u00e3o.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.5. Ainda, o USU\u00c1RIO dever\u00e1 informar um e-mail v\u00e1lido para comunica\u00e7\u00e3o com a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">; sendo que qualquer comunica\u00e7\u00e3o ou notifica\u00e7\u00e3o enviada por e-mail ser\u00e1 considerada v\u00e1lida e eficaz entre as Partes.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.6. Para utilizar os servi\u00e7os prestados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, o USU\u00c1RIO, dentre outras obriga\u00e7\u00f5es previstas neste Termo, deve ser: (i) pessoa f\u00edsica, maior de 18 (dezoito) anos e possuir inscri\u00e7\u00e3o v\u00e1lida e regular perante a Receita Federal do Brasil; ou (ii) pessoa jur\u00eddica devidamente constitu\u00edda, com sede ou escrit\u00f3rio no Brasil e possuir inscri\u00e7\u00e3o v\u00e1lida e regular perante a Receita Federal do Brasil.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.6.1. Para pessoa f\u00edsica menor de 18 (dezoito) anos e maior ou igual a 16 (dezesseis) anos h\u00e1 a necessidade de ci\u00eancia e anu\u00eancia dos pais ou respons\u00e1vel legal, mediante o envio dos respectivos documentos necess\u00e1rios.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.6.2. Em raz\u00e3o de os servi\u00e7os serem prestados de forma remota, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">n\u00e3o possui condi\u00e7\u00f5es de verificar a capacidade civil, autenticidade dos documentos enviados e regularidade do USU\u00c1RIO; de forma que n\u00e3o responder\u00e1 por quaisquer preju\u00edzos que venham a ser causados em raz\u00e3o da inobserv\u00e2ncia das condi\u00e7\u00f5es acima indicadas, estando isenta de qualquer responsabilidade.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.7. \u00c9 vedada a utiliza\u00e7\u00e3o do Sistema e a realiza\u00e7\u00e3o das Transa\u00e7\u00f5es para a celebra\u00e7\u00e3o de neg\u00f3cios: (i) considerados il\u00edcitos, nos termos da legisla\u00e7\u00e3o brasileira; (ii) que importem em viola\u00e7\u00e3o ao Sistema Financeiro Nacional e \u00e0s normas do Bacen e \u00e0s regras das institui\u00e7\u00f5es financeiras, bandeiras, credenciadoras e emissores de cart\u00f5es de cr\u00e9dito e d\u00e9bito; (iii) considerados como crimes financeiros, com o intuito de lavagem de dinheiro, financiamento ao terrorismo e corrup\u00e7\u00e3o, dentre outros crimes correlatos, ainda que indiretamente; (iv) que n\u00e3o representem um neg\u00f3cio jur\u00eddico regular e tenham por inten\u00e7\u00e3o a pr\u00e1tica de fraudes; ou (v) que, de qualquer modo, venham a causar preju\u00edzos \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, seus parceiros, demais USU\u00c1RIOS ou terceiros.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.8. As Transa\u00e7\u00f5es com ind\u00edcios ou suspeitas de fraude estar\u00e3o sujeitas ao n\u00e3o processamento, cancelamento e estorno, ainda que realizada de forma conivente ou n\u00e3o pelo USU\u00c1RIO.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) Em casos de suspeita de fraude pelo Mecanismo Especial de Devolu\u00e7\u00e3o do Pix, poder\u00e1 ser realizado bloqueio da conta, estorno do valor fraudado ou, inclusive, bloqueio dos recursos mantidos na conta transacional, em uma ou mais parcelas, at\u00e9 o atingimento do valor total da transa\u00e7\u00e3o com suspeita de fraude.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.9. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 suspender o acesso \u00e0s Ferramentas e deixar de realizar as Transa\u00e7\u00f5es pelo Sistema sempre que identificar ou entender que a atividade do USU\u00c1RIO ou natureza das Transa\u00e7\u00f5es viola qualquer dispositivo deste Termo ou da legisla\u00e7\u00e3o vigente; podendo sujeitar o USU\u00c1RIO ao cancelamento do seu credenciamento e sua exclus\u00e3o imediata do Sistema, independentemente de qualquer aviso ou notifica\u00e7\u00e3o pr\u00e9via, n\u00e3o gerando ao USU\u00c1RIO qualquer tipo de indeniza\u00e7\u00e3o ou ressarcimento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;3.10. Este Termo passa a vigorar a partir do momento que o USU\u00c1RIO estiver apto e habilitado para realizar Transa\u00e7\u00f5es pelo Sistema, mediante a abertura da Conta de Pagamento.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">4. Conta de Pagamento<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.1. Ao aderir a este Termo, o USU\u00c1RIO concorda com a abertura de Conta de Pagamento individual, de sua exclusiva titularidade, a qual poder\u00e1 ser movimentada por meio das Ferramentas.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.1.1. O simples Cadastro na Plataforma n\u00e3o implica na abertura da Conta de Pagamento, o que somente ocorrer\u00e1 ap\u00f3s:<\/span><br><ul type=\"square\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">(i) preenchimento do Cadastro padr\u00e3o com as informa\u00e7\u00f5es pessoais do USU\u00c1RIO;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">(ii) valida\u00e7\u00e3o dos documentos apresentados; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">(iii) o aporte pr\u00e9vio de recursos, por um dos meios dispon\u00edveis.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.2. O carregamento da Conta de Pagamento se dar\u00e1 por um dos meios dispon\u00edveis no Sistema, de livre escolha do USU\u00c1RIO, dentre os quais:<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) Pagamento de boleto banc\u00e1rio, pelo pr\u00f3prio USU\u00c1RIO &#8211; ou terceiros em seu favor do USU\u00c1RIO -, com identifica\u00e7\u00e3o \u00fanica que permita o carregamento do valor pago na Conta de Pagamento;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(b) Recebimento por meio de transfer\u00eancias realizadas por outros USU\u00c1RIOS, no \u00e2mbito do Sistema; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(c) Recebimento de recursos em raz\u00e3o de Pagamentos Instant\u00e2neos realizados por meio do Pix.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.2.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1, a qualquer momento, estipular outras formas de carregamento da Conta de Pagamento pelo USU\u00c1RIO, mediante altera\u00e7\u00e3o deste Termo e disponibilidade por meio das Ferramentas.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.2.2. Com o carregamento da Conta de Pagamento, por uma das modalidades permitidas, os recursos estar\u00e3o dispon\u00edveis no Sistema em at\u00e9 01(um) dia \u00fatil; sendo poss\u00edvel ao USU\u00c1RIO, a partir de ent\u00e3o, realizar as Transa\u00e7\u00f5es por meio das Ferramentas.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.3. Os recursos depositados na Conta de Pagamento poder\u00e3o ser utilizados para transfer\u00eancia ou resgate, por um dos meios dispon\u00edveis no Sistema, dentre os quais:<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) Realiza\u00e7\u00e3o de Transa\u00e7\u00f5es de transfer\u00eancia para a Conta de Pagamento de outros USU\u00c1RIOS credenciados no Sistema;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(b) Pagamento de d\u00e9bitos do USU\u00c1RIO em raz\u00e3o da compra de produtos ou servi\u00e7os contratados na Plataforma, inclusive para dar cumprimento \u00e0 Autoriza\u00e7\u00e3o de Pagamento;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(c) Resgate de recursos, mediante transfer\u00eancia TED\/DOC para a conta banc\u00e1ria de mesma titularidade do USU\u00c1RIO;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(d) Transfer\u00eancia de recursos por Pagamentos Instant\u00e2neos, por meio do Pix;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(e) Carregamento de Cart\u00e3o Pr\u00e9-Pago emitido para o USU\u00c1RIO, caso dispon\u00edvel.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(f) Saque digital em equipamentos de autoatendimento banc\u00e1rio eletr\u00f4nico, quando o servi\u00e7o estiver dispon\u00edvel ao USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.3.1. A transfer\u00eancia dos recursos entre Contas de Pagamento no \u00e2mbito do Sistema ser\u00e1 realizada no mesmo dia da realiza\u00e7\u00e3o da Transa\u00e7\u00e3o, exceto em rela\u00e7\u00e3o as Transa\u00e7\u00f5es realizadas ap\u00f3s as 22h00 (vinte e duas horas) \u2013 hor\u00e1rio de Bras\u00edlia -, cujos recursos ser\u00e3o disponibilizados no pr\u00f3ximo dia \u00fatil;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.3.2. O resgate de recursos por meio de transfer\u00eancia banc\u00e1ria, quando realizado at\u00e9 as 14h00 (catorze horas) \u2013 hor\u00e1rio de Bras\u00edlia -, ter\u00e3o seus valores dispon\u00edveis no mesmo dia. Quando a opera\u00e7\u00e3o for realizada ap\u00f3s o hor\u00e1rio acima, os valores ficar\u00e3o dispon\u00edveis em 01 (um) dia \u00fatil contado da realiza\u00e7\u00e3o da Transa\u00e7\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.3.3. As Transa\u00e7\u00f5es realizadas por meio das Ferramentas deixar\u00e3o de ser acatadas pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">quando: (i) n\u00e3o houver recursos suficientes na Conta de Pagamento; (ii) o USU\u00c1RIO deixar de fornecer as informa\u00e7\u00f5es suficientes ou fornecer informa\u00e7\u00f5es incorretas para realiza\u00e7\u00e3o da Transa\u00e7\u00e3o; e\/ou (iii) houver ind\u00edcios de fraude ou suspeita ou ato il\u00edcito, de acordo com os termos previstos neste Termo e na legisla\u00e7\u00e3o vigente.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.4. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 alterar e\/ou determinar novos limites de valor m\u00ednimo e m\u00e1ximo para o carregamento das Contas de Pagamento e para a realiza\u00e7\u00e3o das Transa\u00e7\u00f5es, que poder\u00e1 variar de acordo com as informa\u00e7\u00f5es de Cadastro do USU\u00c1RIO, o tipo de Transa\u00e7\u00e3o, a legisla\u00e7\u00e3o vigente ou outro crit\u00e9rio definido pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.4.1. Os crit\u00e9rios acima indicados poder\u00e3o ser alterados a qualquer momento pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, com anteced\u00eancia de 05 (cinco) dias, e mediante publica\u00e7\u00e3o na Plataforma.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.5. Os recursos creditados na Conta de Pagamento do USU\u00c1RIO ser\u00e3o mantidos em conta banc\u00e1ria de titularidade da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, em institui\u00e7\u00e3o financeira de primeira linha, e, nos termos do art. 12 da Lei 12.865\/2013<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(i) constituem patrim\u00f4nio separado, que n\u00e3o se confunde com o da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(ii) n\u00e3o respondem direta ou indiretamente por nenhuma obriga\u00e7\u00e3o da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, nem podem ser objeto de arresto, sequestro, busca e apreens\u00e3o ou qualquer outro ato de constri\u00e7\u00e3o judicial em fun\u00e7\u00e3o de d\u00e9bitos de responsabilidade da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(iii) n\u00e3o podem ser dados em garantia de d\u00e9bitos assumidos pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(iv) n\u00e3o comp\u00f5em o ativo da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, para efeito de fal\u00eancia ou liquida\u00e7\u00e3o judicial ou extrajudicial.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.6. Os \u00f4nus ou b\u00f4nus decorrentes da manuten\u00e7\u00e3o dos recursos em conta banc\u00e1ria de titularidade da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">n\u00e3o poder\u00e3o ser imput\u00e1veis ao USU\u00c1RIO, assim como por ele reclamados.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.6.1. Os recursos mantidos na Conta de Pagamento, salvo se expressamente pactuado de modo diverso, n\u00e3o sofrer\u00e3o qualquer tipo de acr\u00e9scimo ou altera\u00e7\u00e3o, tais como corre\u00e7\u00e3o monet\u00e1ria e juros; e nem haver\u00e1 o pagamento de qualquer remunera\u00e7\u00e3o ao USU\u00c1RIO, independentemente do per\u00edodo que ficarem depositados.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.7. Os valores depositados na Conta de Pagamento devem ser utilizados para pagamentos e transfer\u00eancias, sendo considerados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">recursos em tr\u00e2nsito de titularidade do USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.8. O USU\u00c1RIO n\u00e3o poder\u00e1 ceder ou onerar, a qualquer t\u00edtulo, os direitos sobre os recursos depositados em sua Conta de Pagamento, sem a pr\u00e9via e escrita autoriza\u00e7\u00e3o da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, sob pena de inefic\u00e1cia da cess\u00e3o ou \u00f4nus perante a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.9. O USU\u00c1RIO ter\u00e1 acesso \u00e0s Transa\u00e7\u00f5es realizadas ou pendentes de pagamento pelo acesso ao extrato de sua Conta de Pagamento, podendo visualizar no Sistema, o saldo e hist\u00f3rico das movimenta\u00e7\u00f5es. A disponibiliza\u00e7\u00e3o do saldo e do extrato das movimenta\u00e7\u00f5es caracteriza-se como presta\u00e7\u00e3o de contas, para todos os fins legais.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.9.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">disponibilizar\u00e1 acesso \u00e0s Transa\u00e7\u00f5es realizadas dos \u00faltimos 12 (doze) meses, sendo que ap\u00f3s este prazo a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">n\u00e3o se responsabiliza pela manuten\u00e7\u00e3o das informa\u00e7\u00f5es, cabendo ao USU\u00c1RIO o controle e arquivo, inclusive com a possibilidade de impress\u00e3o do extrato disponibilizado.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;4.10. O USU\u00c1RIO declara-se ciente de que os servi\u00e7os previstos neste Termo se destinam t\u00e3o somente a efetivar pagamentos e recebimentos em moeda nacional, bem como assegura que todos os recursos movimentados em sua Conta de Pagamento ser\u00e3o oriundos de fontes l\u00edcitas e declaradas, isentando a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">de qualquer responsabilidade.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">5. Pagamentos Instant\u00e2neos pelo Pix<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.1. O USU\u00c1RIO poder\u00e1 realizar Transa\u00e7\u00f5es de transfer\u00eancia ou recebimento de recursos, durante 24 (vinte e quatro) horas por dia e em todos os dias do ano, por meio de pagamentos instant\u00e2neos realizados no \u00e2mbito do Pix (\u201cPagamentos Instant\u00e2neos\u201d).<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.2. Os Pagamentos Instant\u00e2neos ser\u00e3o realizados por meio do arranjo de pagamentos Pix, institu\u00eddo pelo Bacen, cujas regras e condi\u00e7\u00f5es o USU\u00c1RIO declara conhecer e aceitar.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.3. O USU\u00c1RIO que optar por realizar uma Transa\u00e7\u00e3o de transfer\u00eancia ou recebimento de recursos no PIX, deve possuir Conta de Pagamento ativa na <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">e escolher um dos meios dispon\u00edveis para envio ou disponibiliza\u00e7\u00e3o pr\u00e9via de informa\u00e7\u00f5es, sendo: (i) Chave Pix; (ii) QR Code din\u00e2mico; e\/ou (iii) QR Code est\u00e1tico.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.3.1. Entende-se por \u201cChave Pix\u201d: informa\u00e7\u00e3o relacionada ao titular de uma Conta de Pagamento ou conta banc\u00e1ria que permite obter as informa\u00e7\u00f5es armazenadas no Diret\u00f3rio de Identificadores de Contas Transacionais (DICT) sobre o usu\u00e1rio recebedor e sua Conta de Pagamento ou conta banc\u00e1ria, com a finalidade de facilitar o processo de inicia\u00e7\u00e3o de Transa\u00e7\u00f5es pelos usu\u00e1rios pagadores e de mitigar o risco de fraude no \u00e2mbito do Pix.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.3.2. Entende-se por \u201cQR Code din\u00e2mico\u201d: c\u00f3digo de barras bidimensional, capaz de carregar uma quantidade maior de informa\u00e7\u00f5es quando comparado aos c\u00f3digos de barras tradicionais, gerado pelo usu\u00e1rio recebedor, para iniciar um ou mais Pagamentos Instant\u00e2neos no \u00e2mbito do Pix, cujas informa\u00e7\u00f5es da Transa\u00e7\u00e3o est\u00e3o fora da codifica\u00e7\u00e3o do QR Code e que apresenta um rol extenso de funcionalidades pass\u00edveis de configura\u00e7\u00e3o por parte do usu\u00e1rio recebedor.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.3.3. Entende-se por \u201cQR Code est\u00e1tico\u201d: c\u00f3digo de barras bidimensional, capaz de carregar uma quantidade maior de informa\u00e7\u00f5es quando comparado aos c\u00f3digos de barras tradicionais, gerado pelo usu\u00e1rio recebedor, para iniciar um ou mais Pagamentos Instant\u00e2neos no \u00e2mbito do Pix, cujas informa\u00e7\u00f5es da transa\u00e7\u00e3o de pagamento est\u00e3o dentro da codifica\u00e7\u00e3o do QR Code e que apresenta poucas funcionalidades pass\u00edveis de configura\u00e7\u00e3o por parte do usu\u00e1rio recebedor.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.4. Para os Pagamentos Instant\u00e2neos de transfer\u00eancia de recursos pelo USU\u00c1RIO, caso a Transa\u00e7\u00e3o n\u00e3o seja realizada por QR Code din\u00e2mico ou QR Code est\u00e1tico, ou o usu\u00e1rio recebedor n\u00e3o possua uma Chave Pix cadastrada, caber\u00e1 ao USU\u00c1RIO informar os dados da conta do usu\u00e1rio recebedor, conforme solicitado no momento da realiza\u00e7\u00e3o da Transa\u00e7\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.4.1. O USU\u00c1RIO tamb\u00e9m poder\u00e1 receber Pagamentos Instant\u00e2neos no Pix, utilizando um dos meios indicados acima.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.5. O USU\u00c1RIO poder\u00e1 realizar a devolu\u00e7\u00e3o, total ou parcial, dos valores recebidos no \u00e2mbito do Pix, no prazo m\u00e1ximo de 90 (noventa) dias e desde que a conta do outro usu\u00e1rio n\u00e3o tenha sido alterada.<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;a. Nos casos de devolu\u00e7\u00e3o relacionada \u00e0 suspeita de Fraude, conforme al\u00ednea \u2018a\u2019 do artigo 3.8, a devolu\u00e7\u00e3o de fundos ser\u00e1 realizada dentro deste mesmo prazo.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.6. O USU\u00c1RIO tamb\u00e9m poder\u00e1 realizar o cadastro de suas Chaves Pix, de modo a simplificar sua identifica\u00e7\u00e3o e facilitar a realiza\u00e7\u00e3o de Pagamentos Instant\u00e2neos no Pix.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.6.1. O USU\u00c1RIO poder\u00e1 realizar o cadastro das Chaves Pix, de acordo com o limite estipulado pelo Bacen (sendo at\u00e9 05 (cinco) chaves para pessoa f\u00edsica e 20 (vinte) chaves para pessoa jur\u00eddica), que ser\u00e3o identificadas por meio de: (i) n\u00famero do CPF\/CNPJ; (ii) n\u00famero do celular; (iii) endere\u00e7o de e-mail; ou (iv) chave aleat\u00f3ria (sequ\u00eancia de letras e n\u00fameros gerados aleatoriamente pelo Bacen).<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.6.2. As Chaves Pix do USU\u00c1RIO poder\u00e3o, mediante comunica\u00e7\u00e3o pr\u00e9via com 07 (sete) dias de anteced\u00eancia, ser portadas para a identifica\u00e7\u00e3o da Conta de Pagamento ou conta banc\u00e1ria perante outra institui\u00e7\u00e3o de pagamento ou banc\u00e1ria.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.6.3. Ainda, o USU\u00c1RIO poder\u00e1 reivindicar a posse de uma Chave Pix vinculada com a conta de outro usu\u00e1rio, mediante a realiza\u00e7\u00e3o de pedido devidamente justificado e acompanhado da documenta\u00e7\u00e3o que comprove a reinvindica\u00e7\u00e3o. O pedido de reinvindica\u00e7\u00e3o ser\u00e1 analisado pelo Bacen no prazo de at\u00e9 14 (catorze) dias.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.7. A realiza\u00e7\u00e3o de Transa\u00e7\u00f5es de Pagamentos Instant\u00e2neos poder\u00e1 ensejar na cobran\u00e7a de Tarifa adicional, em valor previamente informado; observadas as condi\u00e7\u00f5es estabelecidas pelo Bacen para isen\u00e7\u00e3o de pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.8. Para a realiza\u00e7\u00e3o das Transa\u00e7\u00f5es de Pagamentos Instant\u00e2neos, devolu\u00e7\u00e3o das Transa\u00e7\u00f5es e cadastro das Chaves Pix, o USU\u00c1RIO, desde j\u00e1, manifesta seu expresso consentimento, para fins de coleta, tratamento e transmiss\u00e3o das informa\u00e7\u00f5es ao prestador de servi\u00e7os que ser\u00e1 respons\u00e1vel pela liquida\u00e7\u00e3o das Transa\u00e7\u00f5es e realiza\u00e7\u00e3o dos demais atos necess\u00e1rios perante o Pix, inclusive o acesso das Chaves Pix no banco de dados do DICT.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.9. O USU\u00c1RIO declara-se ciente de que, nos termos do regulamento do Pix e demais normas institu\u00eddas pelo Bacen:<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ser\u00e1 respons\u00e1vel pela realiza\u00e7\u00e3o das Transa\u00e7\u00f5es de Pagamentos Instant\u00e2neos, mediante a transmiss\u00e3o dos dados ao prestador de servi\u00e7os respons\u00e1vel pela liquida\u00e7\u00e3o no \u00e2mbito do Pix;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(b) As Transa\u00e7\u00f5es de Pagamentos Instant\u00e2neos apenas poder\u00e3o ser realizadas caso haja recursos dispon\u00edveis na Conta de Pagamento, nos caso de devolu\u00e7\u00e3o iniciada por suspeita de Fraude, conforme al\u00ednea \u2018a\u2019 do artigo 3.8 haver\u00e1 reserva de fundos at\u00e9 a total devolu\u00e7\u00e3o do respectivo valor.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(c) A liquida\u00e7\u00e3o das Transa\u00e7\u00f5es de transfer\u00eancia, recebimento ou devolu\u00e7\u00e3o de Pagamentos Instant\u00e2neos, o cadastro ou reivindica\u00e7\u00e3o de Chaves Pix e os demais servi\u00e7os relacionados com o Pix, ser\u00e3o prestados por prestador de servi\u00e7os contratado pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, na qualidade de respons\u00e1vel pela pr\u00e1tica dos atos no \u00e2mbito do Pix; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(d) Os sistemas do PIX e\/ou do prestador de servi\u00e7os respons\u00e1vel pela liquida\u00e7\u00e3o poder\u00e3o estar indispon\u00edveis em determinados per\u00edodos, independente de aviso pr\u00e9vio, inclusive em caso de manuten\u00e7\u00e3o programada (realizada entre as 20hs00 e 08hs00), impossibilitando a realiza\u00e7\u00e3o de Transa\u00e7\u00f5es.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.10. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 rescindir este Termo em caso de infra\u00e7\u00e3o praticada pelo USU\u00c1RIO, que importe na pr\u00e1tica de fraude, ato il\u00edcito ou utiliza\u00e7\u00e3o indevida do arranjo Pix.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.11. O USU\u00c1RIO poder\u00e1 se utilizar da marca Pix de acordo com as condi\u00e7\u00f5es e limites estabelecidos pelo Bacen, declarando-se ciente de que<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) A marca PIX \u00e9 de titularidade exclusiva do Bacen e sua utiliza\u00e7\u00e3o dever\u00e1 ser realizada em conformidade com os termos do regulamento Pix e do manual de uso relacionado com a marca;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(b) N\u00e3o dever\u00e1 veicular a marca Pix em dimens\u00e3o inferior \u00e0s marcas, s\u00edmbolos ou logotipos dos demais Instrumentos de Pagamento aceitos;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(c) N\u00e3o poder\u00e1 transmitir a impress\u00e3o de que o Pix possui aceita\u00e7\u00e3o mais restrita ou menos vantajosa perante outros Instrumentos de Pagamento aceitos;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(d) N\u00e3o poder\u00e1: (i) reivindicar quaisquer direitos sobre a marca Pix; (ii) questionar a titularidade do Bacen sobre a marca Pix; (iii) registrar ou tentar registrar raz\u00e3o social, nome fantasia, logotipo ou qualquer nome de dom\u00ednio de internet contendo refer\u00eancia \u00e0 marca Pix; (iv) associar a marca Pix a quaisquer produtos n\u00e3o relacionados ao arranjo Pix; ou (v) utilizar a marca Pix al\u00e9m dos limites previstos no regulamento do Pix e respectivos manuais institu\u00eddos pelo Bacen;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(e) N\u00e3o poder\u00e1 utilizar a Marca Pix de modo a acarretar preju\u00edzos ao Bacen ou ao arranjo Pix;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(f) Dever\u00e1 comunicar \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, imediatamente, atrav\u00e9s do e-mail&nbsp;ouvidoria@<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.com.br, sempre que tomar conhecimento do uso indevido, tentativa de c\u00f3pia ou infra\u00e7\u00e3o aos direitos decorrentes da marca Pix; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(g) O uso da marca Pix n\u00e3o confere ao Estabelecimento qualquer direito de titularidade ou outro benef\u00edcio referente \u00e0 marca.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.11.1. O USU\u00c1RIO poder\u00e1 solicitar \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">o envio da arte final apropriada, disponibilizada pelo Bacen para o uso da marca Pix.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;5.11.2. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 rescindir este Termo, automaticamente e de pleno direito, em caso de infra\u00e7\u00e3o grave, praticada pelo USU\u00c1RIO, quanto \u00e0 viola\u00e7\u00e3o das regras de uso da marca Pix.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">6. Disputa e Cancelamento das Transa\u00e7\u00f5es<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 cancelar uma Transa\u00e7\u00e3o sempre que verificar que:<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(i) tiver sido processada incorretamente pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, em raz\u00e3o de informa\u00e7\u00f5es err\u00f4neas indicadas pelo USU\u00c1RIO no momento da realiza\u00e7\u00e3o da Transa\u00e7\u00e3o;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(ii) foi recusada pelo USU\u00c1RIO destinat\u00e1rio dos recursos;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(iii) foi realizada em desconformidade com as disposi\u00e7\u00f5es deste Termo e das Condi\u00e7\u00f5es <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, ou (v) haja suspeita de fraude, ato il\u00edcito ou qualquer irregularidade.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.1.1. Havendo o cancelamento da Transa\u00e7\u00e3o realizada por transfer\u00eancia banc\u00e1ria (TED\/DOC), o respectivo valor ser\u00e1 estornado ao USU\u00c1RIO no prazo de 1 (um) dia \u00fatil.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.2 A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, quando prestador de servi\u00e7o de pagamento do usu\u00e1rio recebedor, poder\u00e1 solicitar a DEVOLU\u00c7\u00c3O de uma Transa\u00e7\u00e3o:<\/span><br><ul type=\"circle\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(i) por iniciativa pr\u00f3pria quando identificar conduta supostamente fraudulenta ou a falha operacional ocorridas no \u00e2mbito de seus sistemas;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(ii) por solicita\u00e7\u00e3o do participante prestador de servi\u00e7o de pagamento do usu\u00e1rio pagador, por meio do DICT, caso a conduta supostamente fraudulenta ou a falha operacional tenham ocorrido no \u00e2mbito dos sistemas desse participante.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.2.1 As devolu\u00e7\u00f5es citadas acima seguir\u00e3o as diretrizes do Mecanismo Especial de Devolu\u00e7\u00e3o conforme Art. 41-C da Resolu\u00e7\u00e3o BCB n\u00b0 103 de 8\/6\/2021.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.2.2 O Processo de devolu\u00e7\u00e3o poder\u00e1 ser iniciado em at\u00e9 90 (noventa) dias contados da data em que houver sido realizada a transa\u00e7\u00e3o original.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.2.3 As devolu\u00e7\u00f5es realizadas no \u00e2mbito deste Mecanismo Especial de Devolu\u00e7\u00e3o, dependem de pr\u00e9via e expressa autoriza\u00e7\u00e3o do usu\u00e1rio recebedor contemplando inclusive a possibilidade de bloqueio dos recursos mantidos na conta transacional, em uma ou mais parcelas, at\u00e9 o atingimento do valor total da transa\u00e7\u00e3o conforme o \u00a7 1\u00ba do Art. 41-C do Regulamento do Pix (Resolu\u00e7\u00e3o 01\/2020 Bacen);<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;6.2.4 A autoriza\u00e7\u00e3o citada no \u00a7 1\u00ba do Art. 41-C poder\u00e1 ser concedida no contrato firmado com o correspondente prestador de servi\u00e7o de pagamento, mediante cl\u00e1usula em destaque no corpo do instrumento contratual, ou por outro instrumento jur\u00eddico v\u00e1lido.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">7. Autoriza\u00e7\u00e3o para o Mecanismo Especial de Devolu\u00e7\u00e3o<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.1 Ao aderir a este Termo, o USU\u00c1RIO concorda com os termos do Mecanismo Especial de Devolu\u00e7\u00e3o autorizando a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">a operar em seu nome, utilizando os recursos de sua conta e procedendo conforme as diretrizes expostas na Resolu\u00e7\u00e3o BCB n\u00b0 103 de 8\/6\/2021.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.2 Caso o USU\u00c1RIO discorde dos termos dispostos no par\u00e1grafo 7.1, por determina\u00e7\u00e3o do Banco Central do Brasil, a conta do cliente dever\u00e1 ser bloqueada e encerrada<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.1.3. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, em nenhuma hip\u00f3tese, se responsabilizar\u00e1 pelo estorno e\/ou cancelamento de Transa\u00e7\u00f5es realizadas por erro nas informa\u00e7\u00f5es indicadas pelo USU\u00c1RIO, cabendo unicamente ao USU\u00c1RIO verificar a exatid\u00e3o das informa\u00e7\u00f5es antes de realizar uma Transa\u00e7\u00e3o no Sistema.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.2. O USU\u00c1RIO declara e garante que ser\u00e1 integralmente respons\u00e1vel pela veracidade, precis\u00e3o e conformidade das informa\u00e7\u00f5es e valores das rela\u00e7\u00f5es comerciais relacionadas com as Transa\u00e7\u00f5es; respondendo, se o caso, pela qualidade, quantidade, seguran\u00e7a, adequa\u00e7\u00e3o, pre\u00e7o, prazo, entrega, funcionalidade e garantias dos produtos ou servi\u00e7os que deram origem \u00e0s Transa\u00e7\u00f5es.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.3. Todas reclama\u00e7\u00f5es e contesta\u00e7\u00f5es decorrentes de quaisquer Transa\u00e7\u00f5es realizadas no \u00e2mbito do Sistema dever\u00e3o ser dirimidas diretamente entre os USU\u00c1RIOS; de modo que a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">estar\u00e1 isenta de qualquer responsabilidade, e sem preju\u00edzo da possibilidade de reten\u00e7\u00e3o e\/ou compensa\u00e7\u00e3o na forma prevista neste Termo.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;a. Em se tratando o Pix, os usu\u00e1rios poder\u00e3o acionar a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">para notificar fraude, apresentando base probat\u00f3ria, e iniciar solicita\u00e7\u00e3o de devolu\u00e7\u00e3o. A solicita\u00e7\u00e3o de devolu\u00e7\u00e3o baseada em suspeita de fraude ser\u00e1 analisada entre os bancos do pagador e recebedor, via Banco Central, podendo ser aceita ou n\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.4. Caso o USU\u00c1RIO apresente contesta\u00e7\u00e3o de uma Transa\u00e7\u00e3o, ser\u00e1 iniciado o procedimento de Disputa, com a reten\u00e7\u00e3o do valor da Transa\u00e7\u00e3o at\u00e9 a solu\u00e7\u00e3o da Disputa.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.4.1. A Disputa dever\u00e1 ser aberta pelo USU\u00c1RIO no prazo m\u00e1ximo de 10 (dez) dias a contar da data de realiza\u00e7\u00e3o da Transa\u00e7\u00e3o, diretamente na central de atendimento da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">dispon\u00edvel na Plataforma; sendo certo que a abertura da Disputa n\u00e3o garante a restitui\u00e7\u00e3o dos valores em discuss\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.4.2. O pedido de abertura de Disputa dever\u00e1 ser devidamente fundamentado e acompanhado da documenta\u00e7\u00e3o pertinente.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.4.3. Com a abertura do procedimento de Disputa, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">solicitar\u00e1 aos USU\u00c1RIOS envolvidos, explica\u00e7\u00f5es e documentos que comprovam a realiza\u00e7\u00e3o do neg\u00f3cio que deu origem \u00e0 Transa\u00e7\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.4.4. Caber\u00e1 unicamente \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, por crit\u00e9rios pr\u00f3prios, analisar a documenta\u00e7\u00e3o e decidir sobre a Disputa, em at\u00e9 30 (trinta) dias contados do envio das informa\u00e7\u00f5es e documentos pelo \u00faltimo USU\u00c1RIO comunicado.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.4.5. Caso a contesta\u00e7\u00e3o seja acolhida, haver\u00e1 o estorno do valor respectivo da Conta de Pagamento do USU\u00c1RIO que iniciou a Disputa. Se a contesta\u00e7\u00e3o n\u00e3o for acolhida, a Transa\u00e7\u00e3o realizada ser\u00e1 mantida.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.5. Caso se identifique n\u00edveis excessivos de pedido de abertura de Disputa perante o USU\u00c1RIO, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1, dentre outras medidas:<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(i) realizar a reten\u00e7\u00e3o, total ou parcialmente, dos valores existentes na Conta de Pagamento, como garantia para cobrir potenciais danos \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ou demais USU\u00c1RIOS; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(ii) suspender ou inabilitar permanentemente o acesso do USU\u00c1RIO \u00e0 Plataforma.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;7.6. As Transa\u00e7\u00f5es ser\u00e3o canceladas, automaticamente, pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, quando:<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(i) for constatada sua duplicidade;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(ii) houver a indica\u00e7\u00e3o de informa\u00e7\u00f5es incompletas ou imprecisas;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(iii) for constatado ind\u00edcios de irregularidade ou fraude;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(iv) nos demais casos previstos neste Termo.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">8. Hip\u00f3teses de Reten\u00e7\u00e3o e Compensa\u00e7\u00e3o de Recursos<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;8.1. O USU\u00c1RIO reconhece e concorda que a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, em conformidade com as disposi\u00e7\u00f5es deste Termo, ter\u00e1 o direito de:<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(i) reter os valores mantidos na Conta de Pagamento do USU\u00c1RIO para garantir, de forma integral, quaisquer pagamentos que sejam devidos \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ou resguardar a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">contra riscos financeiros relacionados as obriga\u00e7\u00f5es do USU\u00c1RIO; e<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(ii) compensar, com os valores mantidos na Conta de Pagamento, os d\u00e9bitos do USU\u00c1RIO perante a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, de qualquer natureza.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;8.2. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">proceder\u00e1 a reten\u00e7\u00e3o e compensa\u00e7\u00e3o dos valores, existentes ou futuros, mantidos na Conta de Pagamento do USU\u00c1RIO, nas seguintes hip\u00f3teses:<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(a) Quando a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">entender que h\u00e1 um alto n\u00edvel de risco operacional ou de cr\u00e9dito, associado ao hist\u00f3rico de Transa\u00e7\u00f5es realizadas pelo USU\u00c1RIO;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(b) Havendo ind\u00edcios de irregularidade ou risco de cancelamento da Transa\u00e7\u00e3o, em raz\u00e3o de den\u00fancias, contesta\u00e7\u00e3o, Disputa ou pelo uso inadequado do Sistema;<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(c) Nos casos em que se verificar a iliquidez, insolv\u00eancia, pedido de bloqueio judicial, pedido de recupera\u00e7\u00e3o judicial ou extrajudicial, pedido de fal\u00eancia, encerramento de atividades ou qualquer outra hip\u00f3tese em que ficar caracterizada a dificuldade do USU\u00c1RIO em cumprir suas obriga\u00e7\u00f5es contratuais e\/ou legais; ou<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;(d) Sempre que houver o descumprimento das obriga\u00e7\u00f5es previstas neste Termo ou na legisla\u00e7\u00e3o vigente.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;8.3. Caso n\u00e3o haja saldo suficiente para arcar com o pagamento dos d\u00e9bitos devidos, o USU\u00c1RIO ser\u00e1 comunicado pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, por um dos meios dispon\u00edveis na Plataforma, para proceda o carregamento imediato de sua Conta de Pagamento, sob pena de caracteriza\u00e7\u00e3o de sua mora, automaticamente e sem a necessidade de aviso ou qualquer formalidade.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;8.3.1. A aus\u00eancia ou atraso no pagamento de quaisquer valores devidos pelo USU\u00c1RIO, ensejar\u00e1 no pagamento de multa morat\u00f3ria de 2% (dois por cento), corre\u00e7\u00e3o monet\u00e1ria pelo IGPM\/FGV ou outro \u00edndice que vier a substitu\u00ed-lo, e juros de 1% (um por cento) ao m\u00eas, a serem calculados sobre a quantia devida.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;8.3.2. A inadimpl\u00eancia do USU\u00c1RIO ensejar\u00e1, ainda, na rescis\u00e3o imediata deste Termo e na ado\u00e7\u00e3o das medidas legais para a cobran\u00e7a do d\u00e9bito, inclusive a inclus\u00e3o da d\u00edvida perante os \u00f3rg\u00e3os de prote\u00e7\u00e3o ao cr\u00e9dito.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;8.4. O USU\u00c1RIO ter\u00e1 o prazo de 90 (noventa) dias para apontar eventual diverg\u00eancia ou incorre\u00e7\u00e3o em rela\u00e7\u00e3o aos valores lan\u00e7ados na Conta de Pagamento, a contar da realiza\u00e7\u00e3o da Transa\u00e7\u00e3o, lan\u00e7amento do d\u00e9bito ou compensa\u00e7\u00e3o. Ap\u00f3s esse prazo, o USU\u00c1RIO n\u00e3o mais poder\u00e1 reclamar dos lan\u00e7amentos realizados, concedendo plena e definitiva quita\u00e7\u00e3o \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">9. Resgate de Recursos e Encerramento da Conta de Pagamento<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.1. O USU\u00c1RIO poder\u00e1, a qualquer momento, desde que possua saldo suficiente para arcar com a tarifa de saque, as tarifas banc\u00e1rias aplic\u00e1veis e o pagamento de eventuais d\u00e9bitos contra\u00eddos perante a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, efetuar o resgate integral dos recursos mantidos na Conta de Pagamento, bem como encerr\u00e1-la, mediante solicita\u00e7\u00e3o \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">via Sistema.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.2. O resgate de recursos ser\u00e1 realizado a pedido do USU\u00c1RIO, mediante o repasse do valor l\u00edquido e em moeda nacional, de acordo com as formas estabelecidas para utiliza\u00e7\u00e3o dos recursos mantidos em Conta de Pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.3. O USU\u00c1RIO se responsabiliza pela exatid\u00e3o dos dados informados sobre a conta banc\u00e1ria de sua titularidade; isentando a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">de qualquer responsabilidade pelas transfer\u00eancias realizadas em raz\u00e3o de informa\u00e7\u00f5es imprecisas ou inexatas que venham a ser informadas pelo USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.4. Caso n\u00e3o seja poss\u00edvel o resgate de recursos por irregularidade na conta banc\u00e1ria indicada, os respectivos valores permanecer\u00e3o retidos e ser\u00e3o mantidos na Conta de Pagamento at\u00e9 que haja a regulariza\u00e7\u00e3o pelo USU\u00c1RIO, sem a incid\u00eancia de quaisquer \u00f4nus, penalidades ou encargos.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.5. Quando decorrente de falha t\u00e9cnica e\/ou operacional no Sistema ou no sistema banc\u00e1rio, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1, sem incorrer em qualquer \u00f4nus ou penalidade, exceder, em at\u00e9 01 (um) dia \u00fatil, o prazo estabelecido para efetuar o resgate da Conta de Pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.6. Na hip\u00f3tese de a data prevista para o resgate de recursos ser considerada feriado ou em dia de n\u00e3o funcionamento banc\u00e1rio, o pagamento ser\u00e1 realizado no 1\u00ba (primeiro) dia \u00fatil subsequente.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.7. A n\u00e3o utiliza\u00e7\u00e3o da Conta de Pagamento, definida como a aus\u00eancia de qualquer utiliza\u00e7\u00e3o pelo prazo de 06 (seis) meses, ensejar\u00e1 na cobran\u00e7a de tarifa de inatividade, para o ressarcimento das despesas com manuten\u00e7\u00e3o, e que ser\u00e1 descontada do saldo existente na Conta de Pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;9.8. A partir do momento em que o USU\u00c1RIO n\u00e3o possuir saldo em sua conta por mais de 90 (noventa) dias, sua Conta de Pagamento ser\u00e1 encerrada pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">independente de aviso-pr\u00e9vio.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">10. Remunera\u00e7\u00e3o da EZZEPAY<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.1. Em contrapartida \u00e0 presta\u00e7\u00e3o dos servi\u00e7os de tecnologia que integram o Sistema, cust\u00f3dia e gest\u00e3o de recurso na Conta de Pagamento e licen\u00e7a de uso das Ferramentas, o USU\u00c1RIO pagar\u00e1 \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">as tarifas, fixas ou percentuais, incidentes sobre cada Transa\u00e7\u00e3o realizada, conforme Anexo I \u2013 Remunera\u00e7\u00e3o da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">(\u201cAnexo Comercial\u201d), que \u00e9 parte integrante e insepar\u00e1vel deste Termo.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.1.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">se reserva no direito de estipular novas tarifas e formas de cobran\u00e7a, al\u00e9m daqueles previstos na Plataforma e\/ou no Anexo Comercial, mediante divulga\u00e7\u00e3o na Plataforma ou no momento da realiza\u00e7\u00e3o da Transa\u00e7\u00e3o.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.2. Os valores das tarifas cobrados pela <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">s\u00e3o vari\u00e1veis de acordo com a natureza de cada Transa\u00e7\u00e3o, encontrando-se sempre dispon\u00edveis para consulta pelo USU\u00c1RIO na Plataforma ou mediante solicita\u00e7\u00e3o por meio dos canais de atendimento dispon\u00edveis.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.3. Para a cobran\u00e7a das tarifas, inclusive por servi\u00e7os adicionais que vierem a ser contratados pelo USU\u00c1RIO, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1, alternativamente: (i) realizar lan\u00e7amentos de d\u00e9bitos na Conta de Pagamento; ou (ii) compensar o valor dos d\u00e9bitos com quaisquer outros cr\u00e9ditos, presentes ou futuros, devidos ao USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.3.1. Caso n\u00e3o haja recursos suficientes para o pagamento das tarifas, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">solicitar\u00e1 ao USU\u00c1RIO o cr\u00e9dito imediato de recursos em sua Conta de Pagamento. T\u00e3o logo haja recursos na Conta de Pagamento, os valores ser\u00e3o debitados automaticamente e sem pr\u00e9vio aviso.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.3.2. Sem preju\u00edzo da suspens\u00e3o dos servi\u00e7os prestados por meio do Sistema, caso o USU\u00c1RIO deixe de realizar o cr\u00e9dito em sua Conta de Pagamento, haver\u00e1 a incid\u00eancia dos encargos morat\u00f3rios estipulados neste Termo.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.4. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 efetuar o reajuste ou altera\u00e7\u00e3o do valor das tarifas cobradas, informando previamente o USU\u00c1RIO, por e-mail ou divulga\u00e7\u00e3o pr\u00e9via na Plataforma.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.4.1. Caso o USU\u00c1RIO n\u00e3o concorde com as novas condi\u00e7\u00f5es de remunera\u00e7\u00e3o, poder\u00e1 encerrar este Termo, sem a incid\u00eancia de quaisquer \u00f4nus ou penalidades. No momento do encerramento pelo USU\u00c1RIO, todas as tarifas pendentes ser\u00e3o cobradas em sua Conta de Pagamento. O n\u00e3o encerramento ser\u00e1 interpretado como anu\u00eancia com rela\u00e7\u00e3o aos novos valores das tarifas cobradas.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.4.2. Caso sejam criados novos tributos ou alteradas as condi\u00e7\u00f5es de c\u00e1lculo e\/ou cobran\u00e7a de tributos incidentes sobre a remunera\u00e7\u00e3o vigente, a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, mediante aviso pr\u00e9vio de 10 (dez) dias, ir\u00e1 alterar os valores cobrados de forma a restabelecer o equil\u00edbrio econ\u00f4mico-financeiro.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.5. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 instituir outras modalidades de remunera\u00e7\u00e3o, inclusive sobre os servi\u00e7os adicionais que vierem a ser pactuados em instrumentos contratuais pr\u00f3prios, mediante pr\u00e9via comunica\u00e7\u00e3o ao USU\u00c1RIO, com anteced\u00eancia de 10 (dez) dias.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.6. Ap\u00f3s o credenciamento no Sistema, o USU\u00c1RIO poder\u00e1, a qualquer momento, solicitar o cancelamento de sua ades\u00e3o e encerramento de sua Conta de Pagamento; mediante pr\u00e9via comunica\u00e7\u00e3o formal \u00e0 <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, com anteced\u00eancia de 30 (trinta) dias.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;10.7. O USU\u00c1RIO concorda que a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, a seu exclusivo crit\u00e9rio, poder\u00e1 alienar, ceder, dar em garantia ou de qualquer forma dispor dos receb\u00edveis decorrentes de sua remunera\u00e7\u00e3o, em nada prejudicando o direito do USU\u00c1RIO de receber o valor l\u00edquido decorrente das Transa\u00e7\u00f5es.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">11. Prazo de Vig\u00eancia e T\u00e9rmino<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;11.1. Este Termo \u00e9 celebrado por prazo indeterminado, e passa a vigorar a partir da data de sua aceita\u00e7\u00e3o pelo USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;11.2. Este Termo ser\u00e1 extinto, a qualquer momento, mediante notifica\u00e7\u00e3o com anteced\u00eancia de 30 (trinta) dias, por qualquer das Partes.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;11.2.1. Salvo quanto \u00e0s hip\u00f3teses abaixo, a extin\u00e7\u00e3o deste Termo se dar\u00e1 sem a incid\u00eancia de quaisquer \u00f4nus, encargos ou penalidades; ressalvadas as obriga\u00e7\u00f5es pendentes e que dever\u00e3o ser devidamente cumpridas pelo prazo necess\u00e1rio.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;11.3. Haver\u00e1 a rescis\u00e3o imediata e motivada deste Termo, nas hip\u00f3teses de: (i) decreta\u00e7\u00e3o de fal\u00eancia, pedido de recupera\u00e7\u00e3o judicial ou extrajudicial ou encerramento das atividades de qualquer das Partes, ao exclusivo crit\u00e9rio da outra Parte; ou (ii) o descumprimento de qualquer obriga\u00e7\u00e3o estabelecida neste Termo que n\u00e3o seja sanada no prazo estipulado ou, na omiss\u00e3o, no prazo de 10 (dez) dias contados da notifica\u00e7\u00e3o ou aviso.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;11.4. Caso a rescis\u00e3o do Termo ocorra por culpa do USU\u00c1RIO, fica desde j\u00e1 estabelecido que seu acesso \u00e0 Plataforma e ao Sistema ser\u00e1 imediatamente bloqueado, com a suspens\u00e3o de sua Conta de Pagamento e reten\u00e7\u00e3o dos cr\u00e9ditos do USU\u00c1RIO pelo prazo necess\u00e1rio para que possam ser resguardados os direitos da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, de outros USU\u00c1RIOS e de terceiros; sem preju\u00edzo da ado\u00e7\u00e3o de outras medidas legais necess\u00e1rias e da apura\u00e7\u00e3o e ressarcimento de eventuais danos complementares.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">12. Responsabilidades Adicionais do USU\u00c1RIO<\/span><\/strong><\/span><\/p>\n<ul style=\"margin-bottom: 1rem;\" type=\"disc\">\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.1. Todos os tributos incidentes na presta\u00e7\u00e3o dos servi\u00e7os e na licen\u00e7a de uso das Ferramentas disponibilizadas no Sistema s\u00e3o de exclusiva responsabilidade do USU\u00c1RIO, podendo a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">descontar os respectivos valores dos cr\u00e9ditos do USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.2. A realiza\u00e7\u00e3o da transfer\u00eancia banc\u00e1ria de recursos oriundas de sua conta corrente banc\u00e1ria, pagamento do boleto, dentre outras opera\u00e7\u00f5es, poder\u00e3o estar sujeitas \u00e0 cobran\u00e7a de tarifas, taxas ou encargos, de acordo com os crit\u00e9rios e valores estabelecidos pelas institui\u00e7\u00f5es financeiras; sendo que a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">n\u00e3o possui qualquer inger\u00eancia sobre os valores cobrados do USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.3. O USU\u00c1RIO reconhece e concorda que a realiza\u00e7\u00e3o das Transa\u00e7\u00f5es pelo Sistema est\u00e1 sujeita a aplica\u00e7\u00e3o da legisla\u00e7\u00e3o vigente, inclusive de preven\u00e7\u00e3o a lavagem de dinheiro, financiamento ao terrorismo e combate \u00e0 corrup\u00e7\u00e3o; estando os repasses dos valores das Transa\u00e7\u00f5es sujeitos ao estrito cumprimento da legisla\u00e7\u00e3o aplic\u00e1vel.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.4. Para utiliza\u00e7\u00e3o das Ferramentas e acesso ao Sistema, o USU\u00c1RIO dever\u00e1 possuir equipamentos (smartphone, tablet ou outros dispositivos similares) com acesso \u00e0 internet e em condi\u00e7\u00f5es compat\u00edveis para seu uso, sendo de exclusiva responsabilidade do USU\u00c1RIO a obten\u00e7\u00e3o, manuten\u00e7\u00e3o e custeio de tal acesso e dos equipamentos necess\u00e1rios (incluindo tributos, tarifas ou encargos cobrados pelos fornecedores de servi\u00e7os). A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">n\u00e3o ser\u00e1 respons\u00e1vel pela n\u00e3o realiza\u00e7\u00e3o da Transa\u00e7\u00e3o em raz\u00e3o da incompatibilidade dos equipamentos ou pela aus\u00eancia ou falha no acesso \u00e0 internet.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.5.&nbsp;<strong>O USU\u00c1RIO compromete-se a isentar a EZZEPAY de toda e qualquer reclama\u00e7\u00e3o ou lit\u00edgio judicial ou extrajudicial decorrente da utiliza\u00e7\u00e3o do Sistema, inclusive no que se refere \u00e0s pr\u00f3prias atividades do USU\u00c1RIO e \u00e0s quest\u00f5es relacionadas com os neg\u00f3cios jur\u00eddicos celebrados pelo USU\u00c1RIO fora do Sistema.<\/strong><\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.6. O USU\u00c1RIO obriga-se a ressarcir a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">de todos os valores comprovadamente despendidos em a\u00e7\u00f5es judiciais ou processos administrativos que tenham sido ajuizados contra a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">em raz\u00e3o do descumprimento de obriga\u00e7\u00f5es imput\u00e1veis ao USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.6.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">poder\u00e1 reter os cr\u00e9ditos a serem pagos ao USU\u00c1RIO e compens\u00e1-los para o pagamento de d\u00e9bitos decorrentes de condena\u00e7\u00f5es, custas e despesas processuais, al\u00e9m de honor\u00e1rios advocat\u00edcios.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.7. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">possui uma Pol\u00edtica de Privacidade que indica como as informa\u00e7\u00f5es do USU\u00c1RIO ser\u00e3o coletadas, utilizadas, armazenadas, tratadas, compartilhadas, divulgadas e protegidas. O USU\u00c1RIO deve ler atentamente a Pol\u00edtica de Privacidade, que \u00e9 parte integrante deste Termo.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;12.7.1. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ir\u00e1 adotar todas as medidas necess\u00e1rias e se utilizar de tecnologias adequadas para proteger a coleta, processamento e armazenamento das informa\u00e7\u00f5es do USU\u00c1RIO; por\u00e9m n\u00e3o tem como assegurar que terceiros n\u00e3o autorizados se utilizem de meios fraudulentos para furto, uso indevido, altera\u00e7\u00e3o ou acesso n\u00e3o autorizado \u00e0s informa\u00e7\u00f5es do USU\u00c1RIO.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">13. A <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">autoriza o uso pelo USU\u00c1RIO das Ferramentas que integram o Sistema, de sua titularidade e propriedade, durante o prazo de vig\u00eancia deste Termo, mediante os termos e condi\u00e7\u00f5es ora estabelecidos.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;13.2. O USU\u00c1RIO reconhece e concorda que a propriedade intelectual das Ferramentas \u00e9 de integral e exclusiva titularidade da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;13.2.1. \u00c9 vedado ao USU\u00c1RIO: (i) copiar ou transferir de qualquer forma, total ou parcialmente, quaisquer funcionalidades ou informa\u00e7\u00f5es relativas \u00e0s Ferramentas; (ii) modificar as caracter\u00edsticas das Ferramentas ou realizar sua integra\u00e7\u00e3o com outros sistemas ou softwares; (iii) copiar os dados extra\u00eddos do Sistema, exceto aqueles relativos \u00e0s movimenta\u00e7\u00f5es da Conta de Pagamento.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;13.3. O USU\u00c1RIO compromete-se a n\u00e3o infringir quaisquer direitos relativos \u00e0s marcas, patentes, software, dom\u00ednio na internet, segredo industrial ou, ainda, direito de propriedade industrial ou direito autoral de quaisquer servi\u00e7os ou Ferramentas disponibilizados no \u00e2mbito deste Termo, bem como a n\u00e3o usar o nome, marca, logomarca ou qualquer tipo de sinal distintivo da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ou de seus parceiros, sem o consentimento pr\u00e9vio e escrito.<\/span><\/li>\n<\/ul>\n<p style=\"margin-bottom: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; line-height: 107%; font-family: Gotham, serif; color: #5e239d;\"><br><!-- [if !supportLineBreakNewLine]--><br><!--[endif]--><\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"color: #5e239d;\"><strong><span style=\"font-size: 13.5pt; font-family: Gotham, serif;\">14. O USU\u00c1RIO declara-se ciente e concorda que, independentemente do local de onde esteja utilizando os servi\u00e7os que integram o Sistema, a rela\u00e7\u00e3o entre as Partes ser\u00e1 sempre regida pela legisla\u00e7\u00e3o brasileira.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;14.2. O USU\u00c1RIO expressamente autoriza a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">a utilizar as informa\u00e7\u00f5es, ainda que relativas ao seu Cadastro, Conta de Pagamento, conta corrente e Transa\u00e7\u00f5es realizadas no Sistema, para forma\u00e7\u00e3o de banco de dados, preservando-se a individualidade e identifica\u00e7\u00e3o de cada USU\u00c1RIO.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;14.3. O USU\u00c1RIO autoriza a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">a verificar e trocar informa\u00e7\u00f5es cadastrais, credit\u00edcias e\/ou financeiras a seu respeito em \u00e2mbito nacional, com entidades financeiras ou de prote\u00e7\u00e3o ao cr\u00e9dito, inclusive a efetuar consultas a sistemas de risco de cr\u00e9dito sobre eventuais d\u00e9bitos de responsabilidades do USU\u00c1RIO e a prestar ao \u00f3rg\u00e3o citado informa\u00e7\u00f5es dos dados cadastrais e informa\u00e7\u00f5es credit\u00edcias.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;14.4. Nos termos da legisla\u00e7\u00e3o aplic\u00e1vel e da Pol\u00edtica de Privacidade, o USU\u00c1RIO concorda que a <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">ou qualquer de seus parceiros enviem mensagens de car\u00e1ter informativo ou publicit\u00e1rio.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;14.5. Este Termo suplanta, substitui e prevalece sobre qualquer acordo ou contrato pr\u00e9vio, escrito ou verbal, que tenha sido levado a efeito pelas Partes com rela\u00e7\u00e3o aos assuntos aqui contemplados.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;14.6. Quaisquer d\u00favidas ou quest\u00f5es relacionadas \u00e0 utiliza\u00e7\u00e3o do Sistema, incluindo problemas com a utiliza\u00e7\u00e3o da Plataforma, do Sistema, Cart\u00e3o Pr\u00e9-pago e realiza\u00e7\u00e3o de Transa\u00e7\u00f5es, poder\u00e3o ser dirimidas pelo USU\u00c1RIO na Central de Atendimento da <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">, dispon\u00edvel nas seguintes formas: (i) diretamente na Plataforma; (ii) por e-mail, no endere\u00e7o:&nbsp;contato@<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY<\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">.com.br.<\/span><\/li>\n<li style=\"color: #373643; margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">&nbsp;14.7. O USU\u00c1RIO\/CLIENTE est\u00e1 ciente e concorda que a conta de pagamento de sua titularidade ser\u00e1 aberta diretamente na CELCOIN INSTITUI\u00c7\u00c3O DE PAGAMENTO S.A, inscrita no CNPJ n\u00ba 13.935.893\/0001-09, empresa parceira contratada pela EZZEPAY SOLU\u00c7\u00d5ES DE PAGAMENTOS LTDA para presta\u00e7\u00e3o da solu\u00e7\u00e3o tecnol\u00f3gica de Banco como Servi\u00e7o (&#8220;Bank as a Service&#8221;\/&#8221;BaaS&#8221;), que contempla os procedimentos de abertura e gerenciamento de contas de pagamento, emiss\u00e3o de moeda eletr\u00f4nica e servi\u00e7os de processamento e liquida\u00e7\u00e3o.&nbsp;<\/span><\/font><\/li>\n<li style=\"margin-bottom: 15pt; text-align: justify; line-height: normal; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><font color=\"#5e239d\" face=\"Gotham, serif\"><span style=\"font-size: 18px;\">15.2. O USU\u00c1RIO\/CLIENTE est\u00e1 ciente e concorda que todos os dados fornecidos para abertura e manuten\u00e7\u00e3o da conta, ser\u00e3o utilizados pela CELCOIN apenas para o cumprimento da rela\u00e7\u00e3o contratual firmada com EZZEPAY SOLU\u00c7\u00d5ES DE PAGAMENTOS LTDA dos deveres advindos da regulamenta\u00e7\u00e3o vigente, sempre em observ\u00e2ncia a legisla\u00e7\u00e3o que versa sobre prote\u00e7\u00e3o de dados e seguran\u00e7a da informa\u00e7\u00e3o. Todas as contas ser\u00e3o abertas com a cesta de tarifa gratuita, sendo a Folha para conta de Pessoa F\u00edsica e Econ\u00f4mica para conta Pessoa Jur\u00eddica. O USU\u00c1RIO poder\u00e1 solicitar a altera\u00e7\u00e3o da cesta de tarifas <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">EZZEPAY <\/span><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">que encaixe em suas necessidades para melhor atend\u00ea-lo, conforme detalhamento abaixo.<\/span><\/p>\n<p style=\"margin-top: 0cm; text-align: justify; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; margin-bottom: 1rem;\"><span style=\"font-size: 13.5pt; font-family: Gotham, serif; color: #5e239d;\">2.1.
